1. Acceptance of Terms
By creating an account or using BrandGoblin AI ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free-tier users and Creator Pro subscribers.
2. Account Use
- You must be at least 13 years old to use the Service.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You may not share your account with others or create accounts on behalf of third parties without their consent.
- We reserve the right to suspend or terminate accounts that violate these terms.
3. Free Tier
BrandGoblin AI offers a free tier that includes brand generation (names, story, voice, colors, logo direction), access to Goblin Studio with Creative Energy included, and free Nix stickers and wallpapers. No credit card is required for the free tier. We reserve the right to modify or discontinue free-tier features at any time with reasonable notice.
4. Creator Pro Subscription
Creator Pro is a paid subscription at $19 per month. By subscribing, you agree to the following:
- Your subscription renews automatically each month until you cancel.
- You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then.
- Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service.
- We reserve the right to change the price of Creator Pro with at least 30 days' notice to existing subscribers.
5. Creative Energy
Goblin Studio features (image generation) run on Creative Energy. Free-tier users receive a monthly Creative Energy allowance. Creator Pro subscribers receive a larger monthly allowance and may purchase additional Creative Energy top-ups at any time without a subscription. Creative Energy does not roll over between billing periods unless otherwise stated.
6. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Infringe the intellectual property rights of others.
- Attempt to reverse-engineer, scrape, or extract data from the Service in an automated manner.
- Use the Service to train competing AI models.
- Impersonate any person or entity.
- Violate any applicable law or regulation.
We reserve the right to remove content and suspend accounts that violate these guidelines.
7. Intellectual Property
Content you generate using BrandGoblin AI is yours to use for your own business purposes, subject to any restrictions imposed by the underlying AI model providers. BrandGoblin AI retains ownership of the platform, its design, code, and the Nix character. You may not reproduce or redistribute the BrandGoblin AI platform itself.
8. Service Provided As-Is
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any generated content will meet your specific requirements. To the fullest extent permitted by law, BrandGoblin AI disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, BrandGoblin AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
